Terms of Use
By visiting and/or shopping at the Mount Sushi web site you ("the customer") acknowledge(s) that you have read, understood and accept the following conditions of use. These conditions may be changed without notice, and you are advised to check the current set of conditions before making a purchase. The conditions in place at the time of your purchase will be applied to your order. Separate conditions apply to your use, if any, of PayPal, for credit/debit card and PayPal account payment processing.
Whilst every effort is made to ensure the accuracy of the information presented on our web site, Mount Sushi ("we") is under no obligation to provide products if the information on the site is incorrect. This would apply if for example, if the wrong price were displayed.
Mount Sushi reserves the right to make changes to prices at any time and without notice. Such price changes may result, but not be limited to, changes imposed by our suppliers. In the event that this occurs after you have placed an order, and the total value of your order would therefore be affected, we will make every effort to check with you to see if you still wish to receive the item at the new price. If we are unable to obtain a response from you, but have received payment to our satisfaction, we may at our discretion dispatch your goods anyway. All prices are displayed in pounds sterling (£), and include the appropriate rate of VAT where applicable.
All payments are taken at the checkout stage. Credit/debit card payments, and payments made using existing funds in a customer's PayPal account, are processed separately on a secure server by PayPal. Orders paid by cheque or postal order will not be dispatched until payment has cleared in full. This usually adds up to 7 working days to the order process but this may be longer in exceptional circumstances. Where this process continues more than 30 days after you place your original order, we will, in accordance with Distance Selling Regulations, contact you to discuss the situation. In this circumstance, you will have an additional opportunity to cancel your order.
Mount Sushi is under no obligation to accept or honour any order, and in the event that Mount Sushi is not prepared to accept an order, it will refund the total amount paid in full, except where costs have been incurred by Mount Sushi. In such a situation, these costs may be deducted from the sum refunded to the customer. Our acceptance of an order takes place when the goods are dispatched, and the contract between you and Mount Sushi Limited is formed at that point.
Where the high cost of delivery for a very large order would put Mount Sushi at a significant disadvantage, an additional contribution towards delivery may be asked of the customer. If the customer does not wish to make this additional contribution, Mount Sushi may cancel the order or delivery only part of the order.
Where an order of a high quantity of a specific line of product would deplete our stocks and we cannot reasonably obtain additional stock in time to satisfy future customer requirements, we may choose to only supply part of your order.
Mount Sushi makes every effort to dispatch orders received before 3pm (British time), the same working day. However, this is not a guarantee and you will have no right to compensation if your order is not dispatched within this timeframe. Unless otherwise specified and paid for (for example, by Express Delivery), goods are dispatched either by Royal Mail 2nd Class Standard or, for heavier orders, Royal Mail Standard Parcels Service. Your order should usually arrive within 3-5 working days of dispatch, but this is not a time-guaranteed service. If you require a time-guaranteed delivery option, you should use our Express Delivery service. We are unable to entertain claims for lost or undelivered items until 15 days after dispatch. When this period has passed, refund requests will be assessed as per our returns policy. We will always fulfil the minimum obligations imposed on us by Distancing Selling Regulations.
Equally, the Express Delivery service, for which a delivery surcharge is payable, guarantees delivery by 1:00pm (British time) the next working day after dispatch, not after ordering. In the event that this guarantee is not met by our delivery service provider, we will refund the delivery surcharge but not the cost of the goods themselves. Additionally, we will not refund the standard delivery charge unless the goods are undelivered.
Delivery will be made to the address specified by you on the completed order form. We reserve the right to charge for any extra carriage costs incurred should the incorrect address by entered on your order. Please note that Mount Sushi Limited will not be responsible for any lost or damaged parcel as a result of incomplete or inaccurate address. Mount Sushi Limited can only be responsible for delivery to an address that has been registered with Royal Mail (www.royalmail.com). We cannot guarantee delivery to any address that is not registered with Royal Mail.
While every effort is made to make true representations of the products displayed on our web site, there may be some variation in colour or packaging, due to supply problems or changes.
We rotate our stock regularly in order to ensure that we are both able to reduce waste and to supply you with goods that have the longest possible shelf life. We do not dispatch goods that have passed their ‘Best Before' date, but we do not guarantee how long they will have left, when they arrive with you, before they pass the ‘Best Before' date. This may especially be the case where a delay occurs in the postal system. We do not sell quickly-perishable goods with a ‘Use By' date.
Your access to the Mount Sushi web site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. This may also be caused by unexpected server downtime. Mount Sushi Limited will attempt to restore the service as soon as it reasonably can.
Where the product you have ordered is unavailable, we may choose to substitute it with a similar product unless you have specifically requested that we do not. In the event of such a substitution, you will be charged the price of the product we send you, but you are entitled to a full refund if you are not happy with the substitution, provided you return it to us in its original condition as per our returns policy. If we are unable or choose not to substitute an item, we will remove the item from the order and deduct the item price from the total order cost accordingly. If payment has at this point already been collected, we will make the appropriate refund to your original payment method within 28 days of your order being placed.
We make every effort to deliver your order as quickly as possible. However, delays are sometimes inevitable, and may be caused by low stock levels, a high volume of orders, problems with our suppliers or delays within the postal system. In accordance with Distance Selling Regulations, we will contact you in the unlikely event that your goods will be delivered more than 30 days after you placed your order. In these circumstances you will have an additional right to cancel.
In accordance with Distance Selling Regulations, you may cancel your order and return goods at your cost within 7 days of delivery. You will be entitled to a full refund, excluding any delivery charge. The refund will be issued to your original payment method within 28 days. Further details are available within our returns policy, accessible through our web site or on request. Refunds for goods purchased under a promotional offer will be based on the terms of the promotional price. Your statutory rights are not affected.
By placing an order with us or supplying your details for any other reason, you agree to receive occasional promotional material from us, by e-mail or post. This may in the future include a regular e-mail newsletter. If you would prefer that your details were not used in this way, you should advise us, either in writing or by e-mail at sales@mountsushi.co.uk. Your details will still be stored by us for accounting purposes and in accordance with UK law, but you will not receive correspondence from us, other than that which is directly related to your order.
The Mount Sushi web site is available for non-commercial and domestic use only. Mount Sushi Limited reserves the right to refuse orders from businesses or that we consider are for commercial or other non-domestic concerns.
The Mount Sushi web site is provided by Mount Sushi Limited without any warranties or guarantees. You must bear the risks associated with the use of the Internet. The Mount Sushi web site provides content from other Internet sites or resources and while Mount Sushi Limited tries to ensure that material included on the Mount Sushi web site is correct, reputable and of high quality, it cannot accept responsibility if this is not the case. Mount Sushi Limited will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Mount Sushi web site. If Mount Sushi Limited is informed of any inaccuracies in the material on the site we will attempt to correct the inaccuracies as soon as we reasonably can.
In particular, we disclaim all liabilities in connection with incompatibility of the Mount Sushi web site with any of your equipment, software or telecommunications links; with technical problems including errors or interruptions of the Mount Sushi web site; with unsuitability, unreliability or inaccuracy of the Mount Sushi web site; and with the inadequacy of the Mount Sushi web site to meet your requirements.
To the full extent allowed by applicable law, you agree that we will not be liable to you and/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Mount Sushi web site.
As a convenience to our customers, the Mount Sushi web site includes links to other web sites or material that are beyond its control. Mount Sushi Limited is not responsible for this external content, or for any other site outside of the Mount Sushi web site.
Mount Sushi Limited makes no promise that materials on the Mount Sushi web site are appropriate or available for use in locations outside the United Kingdom, and accessing the Mount Sushi Web Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.
The content of the Mount Sushi web site is protected by copyright. You may retrieve and display the content of the Mount Sushi web site on a computer screen, store such content in electronic form on disk (but, excepting search engine computers, not on any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
If you breach these Terms and Conditions and Mount Sushi Limited ignores this, Mount Sushi Limited will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions. Additionally, these Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.
Mount Sushi Limited shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.
A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
